Terms of Service

Last updated: 7 October 2026

1. Agreement to these Terms

1.1 These Terms of Service (these "Terms") form a binding agreement between you and tnysocial LLC, the operator of the Service, and govern your access to and use of the Service.

1.2 By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not access or use the Service.

1.3 Nothing in these Terms takes away any rights you have by law as a consumer.

1.4 If you come to the Website from one of our ads, the Privacy Policy (Section 11) explains what we tell the company that showed you the ad and how to switch it off. In the UK and the EU we only do it if you tick the box for it when you make your character; accepting these Terms is not agreeing to it.

1.5 If you got the App from Apple's App Store, Apple's Licensed Application End User License Agreement also applies to your use of the App, alongside these Terms.

2. Definitions

In these Terms, the following terms have the meanings set out below:

3. Eligibility and Minors

If you are under the age of 13 (or under the age of digital consent in the country where you live), you may use the Service only with the permission of a parent or legal guardian.

4. License to Use the Service

4.1 Grant of License

Subject to your compliance with these Terms, tnysocial grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the Service for your personal entertainment.

4.2 Restrictions

Except as expressly permitted by these Terms, or to the extent that applicable law expressly permits it despite this restriction, you must not copy, modify, distribute, sell or lease any part of the Service, or reverse engineer it or attempt to extract its source code.

4.3 Reservation of Rights

All rights not expressly granted to you in these Terms are reserved by tnysocial.

5. Accounts

5.1 How Accounts Work

Your Account is stored on our servers and is linked to a secret code kept in your browser (or, in the App, on your device) or, if you sign in, to your Google or Apple account. Signing in is optional.

5.2 Guest Accounts

Except as described in the Privacy Policy, Guest Accounts are deleted after 30 days without a visit. If you play as a guest and clear your browser data or delete the App, your Account may be lost permanently, and we cannot always restore it.

5.3 Deleting Your Account

You may delete your Account at any time in the Service's settings (the cog button, or Esc) by choosing Delete my save, as described in the Privacy Policy. Deleting your Account does not cancel a Tide Club membership: cancel it first (Section 9.9), or it keeps renewing.

5.4 Emails

If you sign in, we may email the address linked to your Account about your Account or a purchase, and occasionally about big updates and events in the Service. You can unsubscribe from update emails at any time with the link in each one. In the UK and the EU we send update emails only if you have said yes to them, and accepting these Terms is not saying yes. The Privacy Policy (Sections 5.4 and 5.5) explains how this works.

6. Code of Conduct

6.1 Rules

The Service is shared by everyone, including children. When using the Service, you agree:

  1. to be friendly and welcoming, especially to new players;
  2. not to engage in bullying, harassment, hate, threats or sexual content;
  3. not to share personal information (your own or anyone else's), links or social media handles, and not to ask other people for theirs;
  4. not to post spam, scams or advertising; and
  5. to choose a name that is appropriate for everyone to see.

6.2 No Tolerance for Objectionable Content or Abusive Users

tnysocial does not tolerate objectionable content or abusive users. A breach of this Section may lead to the measures described in Sections 8 and 12.

7. Fair Play

7.1 Prohibited Conduct

You must not:

  1. cheat, including by using bots, macros, auto-fishing scripts or modified clients;
  2. exploit bugs;
  3. attack or overload the Service's servers, or attempt to gain unauthorised access to them;
  4. open many connections, or play from many browser tabs, to gain an advantage; or
  5. create additional Accounts or fake accounts to farm rewards (such as referral gems) or to evade a ban.

7.2 Reporting Bugs

If you find a bug, please report it to [email protected] instead of exploiting it. We welcome such reports, want to fix the bug, and will be grateful for your help.

7.3 Monitoring and Resets

The Service monitors gameplay and may reset progress that was earned by cheating.

8. Chat, User Content and Moderation

8.1 Automatic Filtering

Chat is filtered automatically. Swearing is masked, and messages that break the rules in Section 6 are blocked before anyone sees them.

8.2 Automatic Measures

Sending several blocked messages in a row mutes your chat for a few minutes. If you continue to send censored messages after a warning, you will be kicked from the Service.

8.3 Moderation Measures

We may rename, mute, block or ban players, or remove Accounts, if they break these Terms or spoil the Service for others. Bans may apply to your Account and to the connection (IP address) from which you play.

8.4 Appeals

We try to be fair. Automatic bans come with an appeal code, and you may email [email protected] if you believe we got it wrong.

8.5 User Content

You are responsible for your User Content. You grant tnysocial a non-exclusive, worldwide, royalty-free license to host, store, transmit, display and otherwise process your User Content to the extent necessary to operate, moderate and provide the Service, as described in the Privacy Policy.

8.6 Our Discord Server

We run a community server on Discord. Discord is for ages 13 and over, and Discord's own terms apply there in addition to these Terms, including the Code of Conduct in Section 6. Suggestions and bug reports sent there, or from the Service, pass through the same filter as chat. Linking your Discord account is optional and only gives you roles on that server, nothing in the Service. Rare moments from the Service are shared there with your in-game name unless you turn that off in Settings (see the Privacy Policy).

9. Virtual Items and Purchases

9.1 Free to Play

The Service is free to play. Where available, you can buy gems (the Service's virtual currency) and a starter pack, and join the Tide Club (a monthly membership, Section 9.9), in the App (through Apple) or on the Website (through our payment partners, see Section 9.6). Nothing else is sold for money. Prices are shown before you buy; in the App, in your own currency. If you are under 18, you need a parent's or guardian's permission to buy anything.

9.2 A License, Not Property

Virtual Items, including gems and everything they buy (outfits, boosts and island gifts), are a limited, personal, non-transferable license to use them in the Service. They have no cash value, cannot be exchanged for money or for anything outside the Service, and cannot be sold, traded or given to another player. You must not sell or trade Virtual Items for real money. Bought gems do not expire.

9.3 Blind Boxes

Blind boxes give a random outfit. The odds are shown in the Service before you open one, a box is guaranteed to be Epic or better within 30 boxes and Legendary or better within 100, and a duplicate gives some gems back. Boxes can be opened with gems you earn or buy.

9.4 Fishjack

Where available, Fishjack in the cave (from level 15) is played with in-game coins only. Coins cannot be bought, and you cannot win anything of real-world value.

9.5 Refunds

Purchases in the App are refunded by Apple under its terms. Purchases on the Website can be refunded within 14 days if the gems have not been used (email [email protected]), and as required by law. If a purchase is refunded or charged back, its gems are taken back; if they were already spent, your gem balance can go below zero until you earn or buy more. We never close an Account because of a refund.

9.6 Who Handles Payments

Apple handles purchases in the App. RevenueCat, Inc. is our purchase service. Stripe sells purchases on the Website to you as the merchant of record, and handles tax, receipts and disputes.

9.7 Island Gifts

An island gift you buy with gems is enjoyed by everyone on your Island at the time. Gifts never give coins.

9.8 Changes to Virtual Items

We may change how the Service works, including prices, rewards and odds, to keep the Service fair and enjoyable. If a change takes away something you have in the Service, including something you bought, we will make it up to you.

9.9 The Tide Club

The Tide Club is a monthly membership. Its price is shown before you join and is charged when you join and then every month, at the same price, until you cancel. In the App it is charged to your Apple account.

What it includes: the members' rewards on that month's Tide Track (gems and that month's outfit), which you open as you reach each step; if you join before reaching the first step, you get the first step straight away. Members also get a shell badge and a coloured name in chat. Rewards you have opened are Virtual Items (Section 9.2) and stay yours after your membership ends. Each month's rewards may differ (Section 9.8).

Cancelling: you can cancel at any time. In the App, cancel in your Apple account's subscription settings (on iPhone: Settings, your name, Subscriptions) at least 24 hours before it renews. On the Website, cancel from the Tide Club page in the game. Cancelling stops the next renewal; your membership carries on until the end of the month you have paid for.

Restoring and refunds: in the App, Restore on the Tide Club page brings back a membership bought with your Apple account. Refunds follow Section 9.5: Apple handles refunds of memberships bought in the App; for the Website, email [email protected].

10. Intellectual Property

10.1 Our Rights

The Service, including its art, music, code and name, belongs to tnysocial LLC or its licensors.

10.2 Screenshots, Videos and Streams

You are welcome to share screenshots, videos and streams of the Service. That is the best way to help the Service grow.

11. Availability and Changes to the Service

We work hard to keep the Service running, and the Service will keep changing. It may contain bugs, go offline, change, or reset things, although we will always try hard not to lose your progress.

12. Suspension and Termination

12.1 We may suspend or end your access to the Service, including by the measures described in Section 8.3, if you break these Terms or spoil the Service for others.

12.2 You may stop using the Service at any time, and you may delete your Account as described in Section 5.3.

12.3 Sections 9, 10 and 13 to 18 continue to apply after your use of the Service ends.

13. Disclaimer of Warranties

13.1 To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

13.2 Without limiting Section 13.1, we do not warrant that the Service will be free of bugs or always available, or that your progress will never be reset (see Section 11).

13.3 Nothing in this Section takes away any rights you have by law as a consumer.

14. Limitation of Liability

14.1 To the maximum extent permitted by applicable law, tnysocial is not liable for any loss or damage arising out of or in connection with your use of, or inability to use, the Service, including any loss of Virtual Items, progress or data, and any indirect, incidental, special or consequential loss or damage.

14.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

14.3 Nothing in this Section takes away any rights you have by law as a consumer.

15. Indemnity

To the extent permitted by applicable law, you agree to indemnify tnysocial against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of your breach of these Terms or your User Content.

16. Changes to these Terms

The Service will keep changing, and these Terms may change too. If we change them, we will update the "Last updated" date at the top of this page. If you continue to use the Service after a change, you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles, subject to any mandatory consumer protections of your country of residence.

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and tnysocial about the Service.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.

18.3 No Waiver

If we do not enforce any provision of these Terms, that does not waive our right to enforce it later.

19. Contact

For questions, reports, appeals, or a catch you would like to show off, email tnysocial at [email protected].
